Terms of Service & EULA
These Terms of Service ("Terms") are a binding agreement between you and BeBetter Software LLC, a Nevada limited liability company ("BeBetter Software," "we," "us," or "our"), governing your use of the Sin Guard mobile application and related services (the "App"). Please read them carefully. By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Who can use Sin Guard
You must be at least 18 years old to use the App. By using it, you confirm that you are 18 or older and that you are legally able to enter into this agreement.
2. Sin Guard is not a substitute for professional help — and is not an emergency service
Please take this section seriously.
Sin Guard provides spiritual encouragement, Scripture, devotional content, habit tracking, and self-guided tools. It is not medical, psychological, psychiatric, counseling, or crisis care, and it is not a substitute for professional treatment, your physician, a licensed therapist, your pastor, or a recovery program.
- Nothing in the App is professional advice, diagnosis, or treatment.
- The App is not monitored in real time and cannot help you in an emergency.
- If you are in crisis, thinking about harming yourself or others, or experiencing a medical or mental-health emergency, do not use the App for help. In the United States, call or text 988 (the Suicide & Crisis Lifeline) or call 911. Outside the US, contact your local emergency number. If you can, reach out to a trusted person, pastor, doctor, or counselor.
You are responsible for your own decisions and wellbeing. Always seek the advice of a qualified professional for medical or mental-health concerns.
3. Your account
An account is required to use the App. You can sign in with an email and password, with Apple, or with Google. You agree to provide accurate information, keep your login credentials secure, and accept responsibility for activity under your account. You can delete your account at any time from within the App. Tell us promptly at info@singuard.org if you believe your account has been compromised.
4. License to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on devices you own or control, for your own personal, non-commercial use. We (and our licensors) retain all rights in the App that are not expressly granted to you.
You agree not to:
- copy, modify, translate, reverse-engineer, decompile, or disassemble the App, except to the extent the law expressly permits;
- rent, lease, lend, sell, redistribute, or sublicense the App;
- remove or alter any proprietary notices;
- use the App to break the law, infringe anyone's rights, or harm others;
- attempt to gain unauthorized access to our systems, or interfere with the App's operation; or
- use automated means to access the App in a way that burdens our systems.
5. Premium plans, billing, trials, and refunds
The App offers a free tier and optional paid access ("Premium") through the plans below. Prices may vary by region and may change over time; any change applies to future purchases or billing periods, never to a period you have already paid for.
- Plans.
- Weekly subscription — $4.99 per week, with a 3-day free trial for new subscribers.
- Annual subscription — $49.99 per year, with a 7-day free trial for new subscribers.
- Lifetime access — $129.99, a one-time payment for ongoing access to the included Premium features. This is not a subscription — it does not auto-renew and there are no recurring charges.
- Free trials. Free trials apply to the subscription plans as listed above (3 days for weekly, 7 days for annual). Unless you cancel before the trial ends, your free trial automatically converts to a paid subscription and you will be charged for the first period. The lifetime option does not include a free trial.
- Founding-member pricing. If you subscribe under an early "founding member" locked-price offer, that price will be honored according to the offer's terms for as long as your subscription remains continuously active.
- Billing through the app stores. All purchases — subscriptions and the lifetime option — are processed by Apple (App Store) or Google (Google Play), not by us directly, and are also subject to the applicable store's terms.
- Auto-renewal (subscriptions only). The weekly and annual subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the current period ends. The lifetime option does not renew.
- Managing and cancelling. You manage, change, or cancel a subscription through your Apple or Google account settings — not inside the App. Deleting the App does not cancel a subscription. The lifetime option has nothing to cancel.
- Refunds. Because purchases run through the app stores, refunds are handled by Apple or Google under their policies. We generally cannot issue refunds directly. (Apple: you can request a refund through Apple; Google: through Google Play.)
6. Your content
The App lets you enter content such as journal entries, notes, feedback, and saved verses, and may add community content in future releases ("Your Content").
- You own Your Content. We don't claim ownership of it.
- You give us a limited license to process and display Your Content solely to operate the App for you. Your journal entries stay on your device; we don't use Your Content for advertising and we don't sell it.
- Feedback you send us about the App may be used by us freely to improve our products, without obligation to you.
- You are responsible for Your Content and confirm you have the right to share it.
7. Acceptable use and community standards
When you interact with any current or future shared or community feature, you agree to follow our community standards: treat others with grace and respect, never shame, harass, threaten, or endanger anyone, don't share others' private information, don't give medical or clinical advice, and don't post unlawful, hateful, or explicit content. We may remove content or suspend or terminate access for anyone who violates these Terms. (Community features are not part of the current release; these standards apply if and when they launch.)
8. Spiritual and denominational content
Sin Guard draws on Scripture and Christian devotional material and is intended to serve believers across denominations. Devotional and Scripture content reflects general Christian teaching and is provided for personal encouragement. It is not offered as the official doctrine of any particular church or denomination, and it is not pastoral counsel directed at your specific situation. You remain responsible for your own beliefs and decisions.
9. Intellectual property
The App, its content, design, code, trademarks, and the names "Sin Guard," "BeBetter Software," and "BeBetter SOFT" are owned by us or our licensors and are protected by law. Scripture quotations may be drawn from Bible translations used under the applicable permissions of their publishers. Nothing in these Terms transfers any of these rights to you.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL PRODUCE ANY PARTICULAR SPIRITUAL, BEHAVIORAL, OR PERSONAL OUTCOME. Some jurisdictions don't allow certain disclaimers, so some of the above may not apply to you.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BEBETTER SOFTWARE AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless BeBetter Software from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or the rights of a third party.
13. Termination
You can stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Sections that by their nature should survive termination (for example, intellectual property, disclaimers, limitation of liability, and dispute terms) will survive.
14. Governing law and disputes
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules, except where your local consumer-protection law gives you rights that cannot be waived.
Let's try to resolve it informally first. Before filing any formal claim, please contact us at info@singuard.org so we can try to work it out. Most issues can be resolved quickly this way.
If we can't resolve it, the courts located in Clark County, Nevada will have jurisdiction, and you and we consent to that jurisdiction — again, except where applicable law gives you the right to bring a claim elsewhere.
15. Additional terms for the Apple App Store
If you downloaded the App from the Apple App Store, the following also applies, and you acknowledge and agree that:
- These Terms are between you and BeBetter Software only, not with Apple. Apple is not responsible for the App or its content.
- License scope. Your license to use the App is limited to a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the Apple Media Services / App Store Usage Rules.
- Maintenance and support for the App are our responsibility, not Apple's. Apple has no obligation to provide any support.
- Warranty. We are solely responsible for any product warranties, whether express or implied. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
- Product claims. We, not Apple, are responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to meet a legal or regulatory requirement, and consumer-protection claims.
- Intellectual property. If a third party claims the App infringes their intellectual property, we — not Apple — are responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting," and that you are not on any US Government list of prohibited or restricted parties.
- Contact. Questions or complaints about the App should be directed to us at info@singuard.org / 732 S 6th St Ste R, Las Vegas, NV 89101, USA.
- Third-party terms. You agree to comply with any applicable third-party terms when using the App.
- Apple as third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
16. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date and, for material changes, give notice in the App. Continuing to use the App after changes take effect means you accept the updated Terms.
